The Comstock Act of 1873 can be resurrected from its Zombie status to bypass the Congress of the United States if Trump and Vance are elected. This ancient law remains on the books as a result of the Dobbs decision of the Trump packed Supreme Court which overturned Roe V Wade in 2022.
Based on the premise from 1873 that contraception was lewd, immoral, and promoted promiscuity the availability of contraception is also at risk under the Comstock Act.
Known at the time as an "anti-vice crusader" Anthony Comstock went on a rampage to attack the availablility of contraception, resulting in state laws that gave the government the authority to enter the bedrooms of Americans. In states where the use of birth control was prohibited by law, married couples could be arrested for using contraception in the privacy of their own bedrooms and subjected to a one-year prison sentence.
The statute restricts the dissemination of contraceptives, abortion pills, information about contraceptives, birth control devices and medical supplies across state lines. The strategy to use the Comstock Act to bypass Congress could effectively shut down abortion in all 50 states.
